These Sweepstakes Rules govern and control Spike Play, Inc.’s (“Spike Play”) give away of sweepstakes entries and operation of promotional sweepstakes contests. Notwithstanding the following, you acknowledge that participation in services provided by Spike Play remains subject to all other terms and conditions relating to Spike Play’s operation of its free-to-play social gaming platform found at https://spikeplay.com/ (the “Website”) and/or providing of services relating thereto.
No purchase or payment necessary to participate. A purchase or payment of any kind will not increase a player’s chances of winning any Game. Games are void where prohibited by law.
You acknowledge that Spike Play operates a social gaming platform provided for entertainment purposes and not for the purpose of engaging, promoting, or providing gambling related services or otherwise assisting in the advancement of any gambling activity. All Games are offered free of charge and strictly for private entertainment and amusement purposes only. No Games or any information related to or resulting from the operation of any games may be used in any way for any gambling or wagering purposes, or for any other illegal or prohibited activity.
Spike Play offers two variation of games: (1) Social Games, and (2) Promotions (collectively, the “Games”). The Games consist of sports predictions made by users in accordance with the Game’s applicable rules. Participants have the ability to specify the type of virtual coins used prior to the start of the Games: (i) Spike Coins or (ii) Spike Cash, which determine the variation of games playable.
Social Games are provided solely for entertainment purposes only. Social Games do not offer prizes, and users are not eligible to receive any prize as a result of participating in Social Games. Users may receive “Used Spike Cash” redeemable for prizes from participating in Promotions in accordance with the provisions set forth in these Sweepstakes Rules and Spike Play’s Terms and Conditions, found at https://spikeplay.com/terms (“Terms and Conditions”). All capitalized terms undefined herein shall have the meaning provided to it in the Terms and Conditions.
Social Games are games played with “Spike Coins.” Spike Coins may only be used in accordance with these Sweepstakes Rules and our Terms and Conditions, are provided solely for the purpose of participating in Social Games, have no real-world monetary value, and cannot be withdrawn, redeemed for prizes, cash, or any other form of currency.
Spike Play also gives away sweepstakes entries referred to as “Spike Cash.” Spike Cash can be used to participate in Promotions for a chance to win Used Spike Cash that are redeemable for real prizes and/or cash subject to the terms of these Sweepstakes Rules.
In the event you do not agree or wish to be bound by these Sweepstakes Rules, or our Terms and Conditions or Privacy Policy, your sole remedy shall be to not access Promotions. You expressly agree and acknowledge that any and all dispute regarding your participation in a Promotion shall be resolved in accordance with the provisions contained herein and/or the Terms and Conditions.
1. Eligibility
1.1. Promotions are open only to legal residents of the Permitted Jurisdictions who are Registered Users with an active Account on the Website. All Players must be at least twenty-one (21) years old at time of entry. Entries will not be accepted from individuals under the age of twenty-one (21) and any such entries are void. “Permitted Jurisdictions” means the United States, excluding the State of Connecticut, Delaware, Idaho, Michigan, Mississippi, Montana, Nevada, Washington, and West Virginia. Participation is void where prohibited by law.
1.2. A person who participates in a Promotion is a “Promotion Player”.
1.3. A person who participates in a Social Game is a “Social Game Player.”
1.4. Social Game Players and Promotion Players are collectively referred to as “Players.”
1.5. Promotions are subject to all applicable federal, state, and local laws and regulations. It is the sole responsibility of a Promotion Player to determine whether participation in a Promotion is legal and compliant with all regulations in the jurisdiction in which the Promotion Player resides.
1.6. Employees (including, without limitation, part-time or temporary employees) of Spike Play, and any of Spike Play’s sponsors and their respective parent entities, subsidiaries, affiliated companies and advertising and promotion agencies, and the immediate family and other household members (i.e., spouses, parents, grandparents, children, grandchildren, roommates, housemates, significant others, partners, siblings (half and full) and the steps of each of the foregoing) of each of the above are NOT eligible to enter and/or to win Promotions.
1.7. Participation in a Promotions constitutes the Promotion Player’s acceptance of these Sweepstakes Rules and Spike Play’s decisions, which are final and binding in all matters related to the Promotions. Promotions are provided solely for the purpose of promoting participation in Social Games. If a Promotion Player is, in Spike Play’s sole discretion, determined to be a professional or non-recreational player (i.e. a Player accessing Games for profit-making purposes), or is using systematic methods to obtain prizes, Spike Cash reserves the right to limit entries or exclude the Player from any Promotion(s).
2. How to Enter
2.1. In order to enter a Promotion, you must be a Registered User of the Website, have at least the minimum amount of Spike Cash in your account required for entry, and enter a Promotion in accordance with these Sweepstakes Rules, subject to our Terms and Conditions.

3. How To Collect Spike Coins and/or Spike Cash
3.1. You may collect Spike Coins in one of the following ways:
a. Registering an Account and “Daily Bonus” Giveaways. Each Player will automatically receive free Spike Coins upon registering an Account on the Website. Each Player will also receive free Spike Coins whenever the Player logs into his/her Account and elects to claim his/her “daily bonus.” The specific number of free Spike Coins provided may vary depending on the day, provided the amount thereof will be clearly and conspicuously displayed on the Website. Each Registered User’s ability to claim his/her “daily bonus” shall automatically reset on a twenty-four (24) basis.
b. Participation in Social Games. Each Player may earn Spike Coins from participating in and/or winning Social Games.
c. Promotional Giveaways. Each Player will have the right to receive free Spike Coins by participating in no-cost giveaways hosted by Spike Play and/or through social media platforms affiliated with Spike Play from time to time. Giveaways will be at no cost and the amount of Spike Coins given away will be stated for the applicable giveaway. The terms of any giveaway will be clearly and conspicuously displayed on the Website and/or third party website affiliated with our offering of the giveaway/promotion. Spike Coins will be credited to each eligible Players’ Account upon completion.
3.2. You may collect Spike Cash in one of the following ways:
3.3. The amount of Spike Coins and/or Spike Cash a Player has will be displayed in his/her Account on the Website. Spike Play reserves the right to change the amount of Spike Coins and/or Spike Cash allocated to Players in accordance with these Sweepstakes Rules and/or Spike Play’s Terms and Conditions.
3.4. All Spike Cash awarded without purchase have the same chance of winning all prizes as Spike Cash awarded in connection with the purchase of a product or service. You cannot purchase Spike Cash, and Spike Cash has no monetary value. Neither Spike Cash nor Spike Coins may be sold, transferred, assigned, gifted, traded or sublicensed (including for monetary exchange or for any other value). Spike Cash received via any of the methods described above cannot be redeemed or exchanged for any item of value. Only Used Spike Cash won from participating in a Promotion may be exchanged or redeemed, subject to the Website’s Terms and Conditions and these Sweepstakes Rules. You acknowledge that Spike Cash received with purchase of Spike Coins (or received via the other methods described herein) constitute intangible digital items of no value that are being provided incidental to and in connection with Spike Play’s promotion of the Website, including, but not limited to, your participation in Social Games.
3.5. Use of any automated or other system(s) to acquire Spike Coins and/or Spike Cash or play the Games is prohibited and will result in disqualification and loss of eligibility to participate in the Games. Spike Coins and/or Spike Cash may be forfeited if a Player’s Account is deactivated for any reason, including, without limitation, violation of these Sweepstakes Rules and/or Terms and Conditions.
3.6. Spike Cash not played for 60 days following placement into your Account are deemed forfeited at the sole discretion of Spike Play. Spike Cash and/or Spike Coins may be forfeited if a Player’s Account is terminated for any reason, including, without limitation, violation of these Sweepstakes Rules and/or our Terms and Conditions.
4. Playing Promotions
4.1.Spike Play reserves the right to offer various Promotions as determined in its sole discretion. The amount of Spike Cash required to play any Promotion and the Prizes (including, but not limited to, amount of Spike Cash) earned from playing such Promotion will be made known to each Promotion Player prior to the beginning of the Promotion. The maximum amount of Spike Cash playable in any Promotion is 100 Spike Cash.
4.2. Only Used Spike Cash won following the completion of a Promotion can be redeemed for prizes.
4.3. All of Spike Play’s decisions regarding the operation of a Promotion shall be final and binding.
4.4.Spike Play reserves the right to modify, alter, or change the rules, regulations, and prize amounts of any Promotion at any time in its sole discretion. All changes shall be made known on the Website prior to the beginning of a Promotion. Each Promotion Player acknowledges that he/she shall be responsible for staying up to date with any and all changes made to Spike Play’s operation of Promotions. In the event of modifying a Promotion, a Promotion Player’s continued participation in the Promotion constitutes acceptance of the modified terms.
4.5 Unless Spike Play requires otherwise, any Spike Cash allocated to a Player is required to be played at least once before they are eligible to be redeemed for prizes as Used Spike Cash. Spike Play may, in its sole discretion, require that any Spike Cash allocated to a Player must be played a greater number of times in any combination of Promotions before they are eligible to be redeemed for prizes as Used Spike Cash.
4.6 The odds of winning will vary for each Game and will be published by Spike Play and visible to all Players on the Website. Promotional Players are responsible for choices made in participating in a Promotion, and their win expectancy (i.e., odds of winning Used Spike Cash redeemable for prize(s)) will be a function of these choices A purchase will not increase any Player’s chances of winning any Game.
4.7 Promotional Period: Promotions are offered on the Website concurrently with Spike Play’s offering of Social Games. Spike Play’s servers are the official time-keeping device for all promotions run via Spike Play’s offering of Promotions. Each promotional period runs from the start of January 1 to the end of December 31 for any given year (“Promotional Period”); provided, Spike Play reserves the right to: (i) cancel any Promotional Period and/or any Promotions offered during such period in accordance with these Sweepstakes Rules and/or our Terms and Conditions, and/or (ii) discontinue its offering of Promotions following the conclusion of any Promotional Period, as determined in Spike Play’s sole discretion
5. Winner Notification
5.1. All winners will be notified by private message and/or by email associated with their Account. No Promotion Player may be allowed to redeem any Used Spike Cash for prizes until such Promotion Player’s eligibility has been verified by Spike Play. Spike Play reserves the right to seek additional verification of eligibility or identity prior to awarding prizes for winning entries at its sole discretion. All decisions regarding verification of eligibility are final and binding.
5.2. Potential winners must comply with these Sweepstakes Rules and Terms and Conditions and winning is contingent upon fulfilling all requirements made known by Spike Play.
5.3. The ability to redeem Used Spike Cash won from participation in a Promotion may be forfeited if a potential winner cannot be contacted, fails to comply with Spike Play’s verification requests within the required time period, fails to comply with these Sweepstakes Rules or Terms and Conditions, or if the prize or prize notification is returned as undeliverable. In the event that a potential winner of a Promotion is disqualified or ruled ineligible for any reason, such prize shall be deemed forfeited.
6. Prize Redemption
6.1. All redemptions of Spike Cash won from participation in a Promotion will be paid out in USD (ratio 1:1) using a third party payment provider authorized by Spike Play.
6.2. We reserve the right to limit the amount of the minimum or maximum redemption value for any prize per day as we deem fit in our sole discretion. The minimum redemption of Used Spike Cash that may be requested by a Player is 20 Used Spike Cash accumulated in your Account. Any redemption request that does not satisfy the redemption requirements shall not be permitted. In New York and Florida, the maximum redemption value for a prize won from any one Promotion is less than USD $5,000 and any prize with a value in excess of USD $5,000 will be reduced to a maximum value of USD $5,000.
6.3. By claiming any prize, the winner certifies eligibility and compliance with these Sweepstakes Rules and acceptance thereof constitutes such winner’s agreement to release and to hold harmless Spike Play, and its affiliates, subsidiaries, advertisers, and agencies from any liability arising out of participation in any Promotion. The prize winner is responsible for all applicable taxes. All prize winners and prizes will be reported to governmental tax authorities as required by law. Spike Play reserves the right to verify the eligibility of all potential prize winners to participate in Promotions and/or redeem a Prize prior to the delivery and/or any redemption thereof. If you fail to provide the requested information needed for Spike Play to verify your eligibility to participate in a Sweepstake Game and/or win a prize, or if we determine that you have violated these Sweepstakes Rules, our Terms and Conditions, and/or any other rules specific to the applicable Promotion, the prize may be forfeited and/or we may suspend or terminate your Account.
6.4. No substitution or transfer of prize is permitted. Spike Play reserves the right to substitute the listed prize with another prize of equal or greater value for any reason owing to circumstances outside Spike Play’s reasonable control.
7. Publicity
By participating in a Promotion, each Promotion Player consents to the use of his/her name, voices, pictures, images, or other likeness for advertising, promotional and other purposes as determined by Spike Play without further approval or compensation, worldwide, in perpetuity and in any and all forms of media, whether now known or hereafter devised (except where prohibited).
8. Disqualification
Spike Play reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the operation of a Promotion, the Website, or to be acting in violation of these Sweepstakes Rules or our Terms and Conditions. Spike Play shall be the sole arbiter in all matters relating to Promotions and the interpretation of these Sweepstakes Rules. Entry into a Promotion constitutes agreement by all entrants to abide by these Sweepstakes Rules, our Terms and Conditions, as well as any other rules established by Spike Play.
9. Limitations Of Liability And Release
9.1. By entering into a Promotion, all Promotion Players agree to release, indemnify, and hold harmless Spike Play, and its respective parents, subsidiaries, affiliates, distributors, sponsors, contractors, suppliers and advertising, promotional and judging organizations and each of their respective employees, officers, directors, shareholders and agents (collectively, the “Releasees”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury sustained in connection with receipt, ownership, use, or misuse of a prize, or while preparing for or participating in any qualifying or prize-related activity, or in any other way related to participation in the Promotion.
9.2. By entering into a Promotion, all Promotion Players agree to indemnify, defend and hold harmless Spike Play and its Releasees from and against any and all claims, expenses, and liabilities (including reasonable attorneys/legal fees) arising out of or relating to a Promotion Player’s participation in the Promotion and/or Promotion Player’s acceptance, use or misuse of prizes.
9.3. Spike Play and the Releasees are not responsible for any incorrect or inaccurate information, whether caused by Website users, Promotion Players, or by any of the equipment or programming associated with or utilized in the Promotions and assume no responsibility for (i) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from a Promotion Player’s participation in a Promotion or receipt or use or misuse of any prize (ii) any error, omission, interruption, deletion, defect, or delay in operation or transmission on the Website, (iii) any computer, telephone, cable, satellite, network, electronic or Internet hardware or software malfunctions or failures, problems with connections or availability, (iv) garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, (v) traffic congestion, (vi) unauthorized human intervention, or (vii) theft or destruction, tampering, or unauthorized access to entries and/or entry information. If, for any reason, a Promotion is not capable of running as planned by reason of infection by computer virus, tampering, unauthorized intervention, fraud, tampering, technical failures, or any other causes beyond Spike Play and/or the Releasees control, Spike Play reserves the right, at its sole discretion, to cancel, terminate, modify or suspend such Promotion and/or select the winner(s) from among all eligible entries received for that Promotion prior to the action taken.
9.4. IN NO EVENT WILL SPIKE PLAY OR THE RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, other than A PLAYER’S actual out-of-pocket expenses ARISING OUT OF YOUR PARTICIPATION IN A GAME. WITHOUT LIMITING THE FOREGOING, ALL GAMES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
10. Dispute Resolution
All disputes regarding these Sweepstakes Rules and/or your participation in any Promotion shall be governed in accordance with the terms of the “Dispute Resolution and Arbitration Agreement,” set forth in the Terms and Conditions. Damages are limited to a refund of any money spent purchasing the product or service of Spike Play for which the Spike Cash were awarded, if any.
11. Miscellaneous
11.1. These Sweepstakes Rules shall be governed by the laws of the State of Delaware, without respect to its conflict of laws principles.
11.2. Nothing in these Sweepstakes Rules shall create or confer any rights or other benefits in favor of any third party except as expressly provided herein.
11.3. If you have any questions or concerns regarding these Sweepstakes Rules or wish to request a list of winners during any applicable Promotional Period (within a year from request, except as otherwise limited by applicable law), please contact us at contact@spikeplay.com. Spike Play reserves the right to respond to questions via post updates and/or public communications regarding the operation of a Promotion on the Website.
11.4. All information collected from a Promotion Player shall be subject to the terms set forth in Spike Play’s Privacy Policy. Except as set forth herein, our Terms and Conditions shall govern all other provisions relating to your participation in the Games and/or use of the Website.
11.5 Spike Play reserves the right to cancel, suspend and/or modify the Promotions, with immediate effect, for any reason, including, without limitation, owing to circumstances outside its reasonable control, as determined by Spike Play in its sole discretion.
11.6 Spike Play reserves the right to update, modify, or otherwise amend these Sweepstakes Rules without prior notice, and such changes shall go into effect as of the “Last Updated” date provided above. Your continued participation in the Promotions shall constitute your acceptance of any and all changes to these Sweepstakes Rules. If you do not agree to any changes set forth in these Sweepstakes Rules, then you should not continue to participate in any Promotions.
11.7 Any failure by Spike Play to enforce any provision contained in these Sweepstakes Rules shall not constitute a waiver thereof.
11.8 Promotions are sponsored by Spike Play, Inc. (“Sponsor”).
